WATCH: Cop Threatening Fake Charges Against Innocent Man is Everything Wrong with Police Today

San Bernardino, CA — The next time someone asks you why people don’t trust police, show them this video of a San Bernardino Sheriff’s deputy threatening to make up charges against an innocent man — for no reason.

Duncan Hicks went to the San Bernardino Sheriff’s station last month to file a report but was met with obstinate bureaucracy and eventually threats.

Hicks was attempting to file a report with the department and had done so on multiple occasions without incident. Hicks told CBS Los Angeles this was his third time there and he also called once to file a few custody disputes with his child’s mother. But this time, he says, the deputy refused to write his report down and then took it a step further.

Hicks was politely trying to explain to the deputy that his report was not stating the problem when the cop lost it.

“This is not explaining the incident, sir,” said Hicks.

“K, Duncan. You know what man? I’m about getting tired of you and you’re about to go to jail just so you know,” barks the deputy, threatening an entirely innocent man.

“What am I going to jail for?” asked Hicks.

“I’ll create something you understand? You’ll go to jail. You understand that?”

Remaining vigilant and unafraid, Hicks stood his ground as he knew the cop had no basis to make such threats.

“You can’t say that. How are you gonna create something? That’s against the law,” Hicks said.

The deputy then responds with a complete and total lie by threatening to arrest Hicks for filming. “Recording me like that. That’s illegal without my knowledge. You want to go to jail for that too?”

According to the San Bernardino Sheriff’s Department, however, audio and video recording in the station is allowed.

Hicks then fires back noting that he is only filming because an armed man is threatening to kidnap and cage him for no reason. “You have a gun on your hip. I’m doing this for my protection,” he says.

“Uh, uh, you’re not starting that in my lobby,” says the clerk before the video ends.

As CBS Los Angeles reports, Sheriff John McMahon, released a statement that read in part: “Since viewing the video, our employees’ response to the citizen is not consistent with my expectation of customer service. Additionally, the deputy’s responses are not consistent with the interpretation of the law…”

Hicks told the local news that “If that’s his way of protecting and doing his job I would like him to be fired,” and he is right. However, as of Thursday, the officer in the video is still employed.

Imagine for a moment that you made threats to kidnap and cage someone for the sole purpose of being aggravated with them. Imagine that you made these threats while on the job, at your place of work, and the person you threatened — was a customer. Do you think that for one second you would be able to keep that job — not too mention avoid jail for those threats?

However, if you are a police officer, you can do so with impunity.

These people fail to realize that they are public servants — not little tyrants who can deprive people of their freedom on a whim. I’ve contributed to this forum in many ways, with the intention being to educate the viewership. I have never advocated violence, or harassment. It’s a curious thing to see the potential for turnabout getting attention, when we’ve tried to utilize the ” system” to get remedy and recourse to no avail.           If it is public information, it is not unlawful, according to our attorneys. However, some of the departments have sent screen shots of calls for violence attached to these comments of info. Even though it is entirely out of our hands, we are the ones receiving the legal backlash in the form of threats of lawsuits and cease and desists for those calls of violence.

          That being said, I truely appreciate you respecting our requests. As you can plainly see in our comment forum, we do not censor.

          We try to list the names and numbers to the departments when we cover these stories sometimes as well. If you’d like to start posting that instead, it could be magnitudes more effective.

            I understand your position, and I have never advocated violence or harassment. I spent a decade in law enforcement as I mentioned earlier. I resigned due to corruption. I wasn’t able to take any action until my resignation was rendered, whereupon I used the press as the powerful tool that it is, to ensure the incumbent sheriff was exposed and lost the election, in addition to forcing his Chief deputy to resign. This is an institutional culture, fostered in LE. I don’t violate the law in order to expose these protected criminals Matt. I merely use my skills as an investigator to reveal the tracks they leave behind. Again, all public record, all lawful. Nevertheless, I will refrain from posting these names as you requested. I have great respect for your work and this platform. I take abuse of the defenseless very seriously however. While many states have statutes that exempt certain public officials personal information from the public record, I simply locate the information they have erroneously volunteered. No hacking, no illicit acquisition. The behavior is inclined to change when the protective shield of qualified immunity is eliminated by their own ignorant actions, I post what they volunteered. I’m confident that if one’s home address was made public, one would have a reduced proclivity towards tasering 80 year olds in their community, or bodyslamming 12 year olds and shooting unarmed mentally ill homeless people. I’m of the opinion that exposure of this information could prove harmful to health of the abuser is very unlikely, yet leaves a splinter of doubt and will cause pause before those abusive behaviors are acted upon. So which is the greater harm, protecting the predator, or prevention of the behavior? It remains to be seen. All the best.

            It seems to be the only way to reach a desired result. Cooperation and the endeavor towards that common ground is certainly a better method than obstinate polarizing opposition. The focus should be singular in purpose, and should be clearly defined by parties at interest. I grew up an abused child, and for me I absolutely loath those who are authoritarian and abusive in their approach, especially when it comes to children, women and elders. I simply won’t tolerate that shit. I can’t, in good conscience allow it to occur, and I will stop it, hinder it, oppose it in every facet if it be within my power. While this platform is beneficial, I see it also as a forum for those who refuse to act and merely want to vent, and complain about the injustices they see. I’m am man of action. Injustice is a direct result of ignorance and want, education cures both. I don’t mean education in the formal academic sense, I mean actual learning, by meaningful experience. I’ve never been in trouble with the law but have witnessed this arrogant, pushy, threatening attitude by cops on many occasions, and until it ends, I can’t respect them. I think every police department should have a citizen review panel that has the authority to dismiss abusive cops.

    I have scanned six reports of this incident and “the deputy’s” name is not divulged in any reports. He is a public servant, why is his identity being protected?
    Every investigation and arrest in which “the deputy” was involved is now in question: he could have fabricated in those instances as he threatened to do to Mr. Hicks. He is a poisoned apple.

    Holding police accountable in these types of situations is another reason why we need someone who will continue to investigate misconduct of police officers, make sure statistics regarding police shootings, civilian deaths (unarmed and not) are never hidden from the public (again), and someone who will continue to implement and enforce consent decrees as an attorney general — rather than someone like Sessions who believes that these things are all too harmful to police officers morale and thinks that society has become [wrongly] too hard on police and is making it so officers are less likely to do their jobs for fear of being labeled abusive.
