San Lorenzo, CA — A heartening trend is growing on social media showing that people are waking up to the state persecuting individuals over victimless crimes. The latest example of this trend comes from the Alameda County Sheriff’s department posting a photo of a deputy arresting a man for selling fruits and vegetables on the roadside and attempting to justify it. When people read the department’s justification, they lashed out — peacefully — to let them know what they were doing is wrong.

Legality does not dictate morality. 

The photo, which has sparked so much backlash online, depicts a deputy confiscating strawberries and mangos while the man selling them sits on the sidewalk in handcuffs.

What’s going on in the photo is clear as day. However, the sheriff’s department took to penning a lengthy post in a futile attempt to explain and justify it. Naturally, they were owned by Facebook.

Here is a screen grab of the post below in case it is removed. It contains one of the most epic comments on the entire post.

“This photograph has stirred up quite a bit of controversy on social media so we wanted to put some context to this picture. Some people have used this photo as an opportunity to criticize law enforcement and drive a wedge between us and our immigrant, minority and low income communities,” the sheriff’s office wrote. “Sometimes photos can be deceptive.”

However, nothing in this photo was deceptive and the sheriff’s department statement even confirmed it.


“Our deputy approached this man to advise him that it was illegal for him to sell produce on the corner. When the deputy asked the man for his identification he became resistive and tried to flee. Our intention here was not to arrest him or get in a confrontation with him. We learned, the man is on federal probation and is expected to follow all laws. This is likely the reason he tried to flee,” the sheriff’s department wrote.

The department attempted to justify kidnapping and caging this man because he tried to flee the officer who wanted to kidnap and cage him for selling fruits and vegetables. People saw right through it and hundreds of them went on to let the sheriff know how they feel.

Justify however you want, if a deed doesn’t have an identified victim, it’s not a crime and you become the criminal. Badges don’t grant privileges of immorality,” one Facebook user wrote.

This poor man had likely been arrested for selling vegetables on the street before which is most likely why he ran. By saying the man ran from a kidnapper as a means of justification for kidnapping him is hardly a good point — which is why this dug the department an even deeper hole.

“This is why the people who hate you do. Even IN context this picture still boils my blood. A guy just trying to make some money. We shouldn’t need “law enforcement permission” to peacefully sell a product to make a buck. Victimless crime has no place in a so-called “free country”,” another user wrote. “Talk about turning hall-monitoring into a career.”

While there was no shortage of comments chastising the department for this victimless crime enforcement, sadly enough there were a few scattered comments by champions of the police state interjecting their ridiculous justification as well.

One Facebook user went so far as to somehow apply the two party paradigm to this situation.

Idiot liberals, do you not understand that what he’s selling is unchecked and possibly unsafe and being sold and taken home n fed to your kids with the possibility of making them sick..oh and I’m sure he’s payin taxes on the money he makes huh, not to mention he’s already on probation for breaking other laws…if you agree this is ok and the police are wrong you need to move to the 3rd world country this belongs in…you people are sad. The Police have a hard enough time without dealing with you idiots. BLUE LIVES MATTER”

The comment above illustrates the sheer ignorance which has led to society accepting the enforcement of laws for victimless crimes. The poor uninformed individual who thinks standing up for people’s rights to do as they please without causing harm to their fellow human is ‘liberal’ is sadly just a cog in the wheel that is the police state. Luckily, commenters like him were few and far between.

For the most part, the nearly 2,000 comments were all from people awake to the police state.

Legality doesn’t equate to morality. If there’s no victim there’s no crime and until you stop using violence and extortion against peaceful people everyone’s going to hate you,” one person wrote, summing up the problem of policing in America perfectly.

The bottom line is — in modern day police state, USA — exchanging goods and services is a crime unless the state gets their cut. We are told that this is for our safety and that we could all die if a brown man sells tainted strawberries on the corner. But nothing could be further from the truth.

“Persistent street vending harms local businesses, especially small, start-up food vendors and poses certain health risks such as Ecoli and other food borne illnesses,” writes the sheriff’s department.

E coli is certainly something to worry about, however, it is not nearly as deadly as the police. In fact, police kill 30 to 40 times more people every year than e coli. Also, the overwhelming majority of e coli outbreaks and other foodborne illnesses come from factory farms and corporations whose representatives and owners are never prosecuted for the deaths related to their products.

Ah, but sell some strawberries on a street corner, and you are an enemy of the state who deserves to be kidnapped and caged.

    I’am coming from the direction of being a farmer myself, in the produce business. Saying if you want to sell produce, it’s fine well and good, as long as you go about it the right way, and that is at the Local Farmer’s Market. Not on a street corner like this guy was.

    Yes he was hurting nobody and in itself a victimless crime. Of which he was in violation of the laws that are designed to protect you, the consumer. E Coli is nothing to fool around with, having the potential of making you extremely sick, is easily spread and tough to spot, befor people like you are affected by it. Also it’s fairly easy to avoid, if basic common sense methods like washing or boiling your veggies first, befor consumption is practised. Just like you do at home, when handling raw chicken.That is still not a guarantee you still won’t get it, it just lessens the chances you will.

    I see these guys around all the time. Setting up there wagons loaded with fruit & vegetables and potential death! Finding them more of a annoyance that just pisses me off, knowing I have to jump through hoops of countless rules and regulations, befor I can sell you or a restaurant, a organic carrot. These rules and reg’s they can’t or won’t be bothered with, usually paying no taxes, while flipping off the rules and regulations that I have to follow, and just stuffing the cash into their pockets. To me if that was true, then how come they are there in the first place, avoiding all responsibility to do it the right way !? Paying no taxes, and no insurance for worker’s comp, if a worker gets hurt, that you will be responsible for if they do, while spraying round up and bug killer all over the place. Would you have a bathroom built or a roof done by a unlicensed company !? Of course not. Then why would you buy a strawberry or mango, from a guy on the corner that dosen’t give a shit about you, or anyone else, except what he can put into his pocket ?

I believe the rules I have got to follow, along with the taxes that are collected to maintain and enforce them, are more about safety for you the consumer, as well in order for me to be a farmer in my State, who grows vegetables for public consumption, while practising sustainable organic methods. If the State, County, or City, is making a buck off of it or not . I don’t give a damn, if they do or don’t ! It’s just the price I pay to do my business, and know that for every dollar I spend and make, a portion goes to pay them. What the hell they do with it after that, I don’t give a tinker’s damn most of the time, unless it’s for stupid stuff, like Bullet Trains In California, that go nowhere, or paying for Broken Dams, that we already have payed to fix, Twice !!

Grapes don’t go into season untill Sep-Oct so they’re out to ! So that leaves maybe Strawberries and perhaps Early Corn and Leafy Vegetables like Spinach and Lettuce, from the Southern Valley’s here in California, Nevada and Arizona.

    What is missing is the intersection in the Venn Diagram. Technically it should be a subset.

    Morality is broad and controversial.

    Legality is now made-up instead of attempting to align the statuatory law with the natural law (based on reason).

    Criminality should only involve breaches of the peace and threats to public order and trust, as violence, stealing, cheating and other lying does.

    This does not make non-criminal things moral, only that it is immoral to enforce them using state apparatus instead of something like ostracism.

    But ostracism allows us to differ. Some consider sexual practices immoral, others consider racism or sexism immoral. Then just excommunicate. One reason we had separation of church and state is because it properly divided things – only the state has the sword. Much of today is separating a secular progressive morality that functions (quacks like) a church from the state. Hate crimes is one example.

    I’m fighting for a minimal government. But if you insist on a big government, I will fight to define its largesse to benefit or at least not harm me. Your speech will be the hate speech, not mine. Your medical problems won’t be covered via tax dollars, but mine will. The IRS will audit your organizations, not mine. Either we destroy Government tyranny, or I will try to insure it will destroy you.

Civilians are expected to abide by the law, right down to the most simple laws that if broken harm no one. And yet!! Our governments are NOT held accountable in the same degree!! They break the very laws that bind society together every single day! Corporations get away with murder and are rewarded with tax breaks, and not one fat rich politician or CEO EVER goes to jail or is put in handcuffs. Has this author written against NY and their ban on “large” soft drinks? Or any of the other LIBERAL overlords that want to control every aspect of our lives?
    Second, why does everyone keep claiming victimless crime? Do you know that NO ONE got sick from eating his fruit, or any other person that sets up a stand? I doubt it. In Ca, you are not permitted to produce food products from the home, baked goods and such, due to concern of health safety. Just like Florida was preventing the pastor from supplying food to homeless because it was not in controlled environments in accordance with health and safety laws, it is not about punishing someone for what they are doing, just how they are doing and in the interest of protecting the people. Would any of you sit down to eat in a restaurant that posted a “D” rating from the health board?
    Third, it appears that he was not being detained or arrested for selling his product, but for fleeing from an officer. Otherwise, they would have just told him to pack it up. And, seeing it is outside a house, does anyone know, maybe the residents complained. And, yes, they are protecting business’. Under the same laws that every other store, shop, vendor, have to comply with under the same draconian liberal laws of the California Democrat machine that is enslaving us.

    Now, before anyone wants to start judging me and think they know everything about me, I am neither Democrat or Republican, I am a free thinking, non puppetized American. I decide on topics what I support and what I| stand against, not some party overlord script. I do not support a police state nation, far from what we are, but I also support law enforcement. Not in every action to be sure, but for the most part. You want to change things, vote out your puppet master overlords and drop party politics.
