Lawmaker Counters Drug Testing Welfare Recipients With Bill to Drug Test Politicians

West Virginia just joined a number of other states in proposing to drug test welfare recipients, despite studies proving such testing does nothing but waste taxpayer money. So, a legislator in that state devised the ideal counter-measure: mandatory drug testing for lawmakers.

House Delegate Shawn Fluharty has now introduced a bill requiring legislators to be tested for drugs before each voting session — and those who fail would be prohibited from voting and denied pay.

“I think the public expects us to adhere to the rules that we try to legislate,” said Fluharty in an interview with WTRF. “We have 134 people down here and we should be on their dime living within the standards that we implement. There’s no reason we shouldn’t do it.”

While drug testing those who receive welfare was initiated in several states ostensibly hoping to catch users and abusers to kick them off public assistance, thereby saving substantial cash, it hasn’t worked out that way — not even close.

In Arizona, as Anti-Media reported, one person of the 87,000 receiving benefits tested positive for drugs in the first three years after the program’s implementation, saving the state a whopping $560 — but with each drug test estimated by the ACLU to cost $42, the state literally spent over $3,650,000 to save $560.

And as ThinkProgress explained:

“According to state data gathered by ThinkProgress, the seven states with existing programs — Arizona, Kansas, Mississippi, Missouri, Oklahoma, Tennessee, and Utah — are spending hundreds of thousands of dollars to ferret out very few drug users. The statistics show that applicants actually test positive at a lower rate than the drug use of the general population.”

In fact, though the national drug use rate averages 9.4 percent, “the rate of positive drug tests to total welfare applicants” was below 1 percent in all but one state — and its rate was 8.2 percent.

Suspicionless drug testing that had been mandated for applicants to Florida’s Temporary Assistance for Needy Families (TANF, or welfare) was ruled “an unconstitutional violation of the protection against unreasonable government searches” by a District Court in 2013.

Though testing welfare applicants has been proven unconstitutional, baseless, and completely ineffective, Fluharty’s plan to drug test lawmakers whose supposed job is based on service to the populace should, arguably, be standard practice for all politicians, especially considering their history.

In just the past few years, politicians and law enforcement alike have been caught trafficking massive amounts of drugs. Even staunch advocates for the state’s immoral war on drugs have been caught using and distributing cocaine.

Hypocrisy is about the only steady thing in politics these days, and this bill serves to expose it.

  • Education in America is failing (probably designed to lol). Schools are not teaching kids to speak up or have critical thinking skills. Schools are grooming kids to obey, comply, follow lame social norms, be politically correct, and especially: reject and shame those who think and act different.

ANYONE with authority over many others, need and should be drug tested and psychologically tested to ensure that they can perform their duties with a clear mind without prejudices. There is no need for the government to interfere with private employers. As one of the many tax payers who actually employ those who work in the public sector I think all public employees should be tested just as private industry is often already doing.

For those on welfare if they are on drugs then they have a source of income (legal or illegal) that they are spending on drugs and should not be provided welfare. Why is this so hard to understand? And why is the idea even questioned?

    • Laura Williams Garza – yes – many work places also test for alcohol on the job – so somehow it is not too costly for private industry to do but it is too costly for the government to do…..let me suggest to you that industry sees the cost savings in fewer accidents on the job and better quality control – but according to your way of thinking those are meaningless benefits when applied to public employees? You do know that such testing is not done on every last person every week or month unless there is a known problem don’t you? – how often do you think testing is being done? – what assumptions are you making in asserting the cost is too high? Random drug testing has a significant impact on those who show up to work with drugs in their systems. No doubt the same would be true for welfare recipients – just the threat of a potential random test can do a great deal to curtail abuse. It’s even done in high school sports – seriously – what is the real objection here? Do you really want teachers in class rooms while they are on drugs? Personally I am against the war on drugs – and even would prefer to see all drug use decriminalized – the cost savings on that would far exceed the small cost needed to keep our public employees from abusing drugs while on the job.

    • Why? Once the money is given to the recipient, it is theirs to spend. They could just as easily gamble or give it away or spend it on a compulsive shopping habit. If you pass a hair follicle drug test then fine maybe you don’t need to be re-tested however if you fail assistance you should be offered to help you get off drugs and/or alcohol and receive continued support as needed.

Also, is it moral to remove the mere pittance of benefits that children receive because of their parents actions? ANYONE who receives ANY public money whether it is a paycheck or an assistance check, and I feel even private businesses with government contracts should ALL be drug tested. These are taxpayer funds and in the interest of making the most of these dollars we should be DEMANDING the people receiving, handling, dispersing, etc… these funds be drug free. You have the right to find any other way you like to support your family if you don’t like the policy.

    • Actually: where they’ve tried these procedures, the person applying for welfare fills out a questionnaire. One of the questions is, “do you use any illicit drugs?” If they answer “no” then the state can’t test them. If they answer “yes” then they can be tested.

      So any moron with 4 brain cells left would be able to figure out that they should just lie and then they won’t have to submit to a drug test.

I do not want an “elected” official to be making decisions high off of heroine or Crack (mayor ford) what they do in their own time is their business but not at work and you know damn well they and other people do it. I think if you’re honest and upfront saying “yea I smoke weed/coke/etc.” On the weekends or my off time, they shouldn’t be penalized. Which is why we should decriminalize drugs. But if you are high on the job and they can prove it there on the spot with a non-company in question employed doctor and prove certain side effects of suspected drugs.

  • … I do not believe there should be drug testing for ANYONE. However, at the same time I believe the ones who pass the laws who make it mandatory should also be required to test. Even the leaders say that the sign of a good leader is a person who does not ask another to do something he would not do themselves.

    And if these leaders were ever to be tested (which I do not see it.) it needs to be done for legal drugs also because most of the best (and most dangerous) drugs in the world are LEGAL. If you got the money, there’s no problem getting the prescription. And, uh, they got da money!

If I make a mistake in the field it could cost a few dollars, maybe even hundreds, but not likely thousands or tens of thousands. But I have been on jobs where mistakes at the management/owner level cost tens of thousands of dollars! Allegedly the reason for testing is to get a lower rate on insurance, but I worked a Government contract where there wasn’t a drug test. Hmmm? No test on a government contract. How strange…
