Sunny Nevada Just Killed the Solar Industry with 40% Tax Hike, Derailing the Off-Grid Movement

While Nevadans were celebrating the holidays under solar-powered lights, the Nevada Public Utilities Commission (PUC) voted unanimously to increase a monthly fee on solar customers by 40% while reducing the amount they get paid for excess power sold to the grid. Adding insult to injury, they made the rate changes retroactive, sabotaging consumer investments in solar energy.

This single move by government regulators will effectively kill the solar industry in Nevada and put an end to the surge of people seeking to detach from the grid by harnessing their own energy from the sun. Just as importantly, it serves to protect the profits of Nevada’s public utility company, NV Energy.

“It will destroy the rooftop solar industry in one of the states with the most sunshine…There is so much wrong with the decision,” said SolarCity CEO Lydon Rive. “The one beneficiary of this decision would be NV Energy, whose monopoly will have been protected.”

Two major solar companies, SolarCity and Sunrun, have already left the state, causing upwards of a thousand job cuts. Many more renewable energy jobs are at stake. Solar industry supporters and workers are planning to protest the new rates at a rally in Carson City and Las Vegas, as industry and public outcry may force regulators to reconsider their decision.

One Nevada resident wrote in the Las Vegas Sun that she feels “financially ambushed” after tapping into their retirement savings to become a solar household. Before the rate change, the system would have paid for itself in 14 years, but now that will never happen.

“With the new pricing for [net metering] customers, the value or price of the energy they produce will be vastly reduced. In addition, the flat service charge for NEM customers will rise to three times that charged to nonsolar residential customers, a kind of penalty for producing much of our own electricity. The people with solar on their homes feel cheated; solar businesses are closing or leaving.”

NV Energy—a regulated monopoly with an “authorized rate of return”—is unabashed in saying that the surge in renewable energy is cutting into their profits. Last year the company, owned by Warren Buffett’s Berkshire Hathaway, got Sen. Patricia Farley to draft the amendment that shifted the state’s net metering over to the PUC. In their view, solar customers “don’t pay their fair share to maintain the grid.”

With the rate changes, Nevada regulators are demonstrating the willingness and ease with which government can neutralize the “off-grid” movement while protecting their favorite utilities. Rooftop solar, along with innovations such as Tesla’s Powerwall, represents a huge opportunity for people to free themselves from an energy structure ruled by corporations and state co-conspirators.

Residential solar customers are not the only threat to the profits of NV Energy.

“A consortium of casinos and businesses is looking to leave NV Energy’s grid and start generating their own power, saying they’re being placed at a competitive disadvantage because they’re paying more for energy than their business rivals in nearby states. The state Public Utilities Commission has said it would charge hefty fees — $27 million in the case of Las Vegas data center Switch — to let industrial ratepayers leave the system.”

The fight between NV Energy and the solar industry may be a microcosm of a larger struggle involving the fossil fuel industry. The American Energy Alliance, a fossil fuel advocacy organization backed by the infamous Koch brothers, applauded the Nevada decision as a matter of national policy. They are pushing efforts in other states to curtail the rise of solar energy.

In this vein, the outcome of Nevada’s situation could have implications far beyond that state.

“Nevada could set a precedent for other states, Hugh Wynne, an analyst at Sanford C. Bernstein & Co., wrote in note Tuesday. Regulators across the country are grappling with how to spur the development of clean energy sources while ensuring operators can collect enough money to maintain and update their grids. – Bloomberg News

The question must be asked, why does government protect the status quo? Why is it assumed that existing utility operators must be preserved in this rapidly changing energy landscape? Instead, consider that old utility grids are no longer applicable in the 21st century.

This is a pivotal moment in the evolution of the energy paradigm. We have the ability to leave behind the dirty, corrupt legacy of fossil fuels and enter an era of localized, renewable energy. As The Free Thought Project reported in November, within 25 years we could have a complete energy transformation, as the cost of renewables declines and technology advances exponentially. Rooftop solar and localized systems will lead the revolution.

    • Go 100% off grid and you don’t pay ANY grid connect fee. The problem is there’s no practical way to store the power for when the sun doesn’t shine. People are wanting to use the grid as a personal power storage, but not wanting to pay for it. The standard customer service fee only covers a portion of the actual grid costs.

    • Christopher Russell i know people who DO sell their surplus back to the power company, ones a guy i have gamed with since the 90’s who owns a dairy farm and uses a big collection rig to collect the methane from the cattle, yes he got a govt subsudy to test the gear and the company that sells it has upgraded him a couple times for free in part because first and 2nd gen rigs for doing this had some flaws that in rare cases could lead to methane fires….(not good)

      he pays for eletricity only on rare occations such as when a very cold storm hits in winter and his methane supplies are hit hard but even then hes only paid for power once or twice in the last decade from what he says, he normally is producing enough extra power that the generator rig pushes ALOT of power back into the grid.

      hes got a MASSIVE bank of gel cell deep cycle batteries setup to store power as well, (what use to be stalls for horses in one of the bars was retro fit with a “ghetto” power storage setup….ghetto part is, they built all the stuff to do it themselves rather then buying a bunch of extra stuff from the company that makes the gear for a far higher price…. the batteries he got even have a built in deal that warns if they are starting to fail.. not sure how that works but hey….great idea….

  • Before everyone goes on the attack, try to understand what was actually going on there. The utilities were being required to purchase electricity from solar users at full retail price. This was patently unfair to not only the producers but also non solar homeowners. What they have done is allowed them to now purchase it at wholesale where it should have been all along.

    • This is confusing…solar panels generate electricity, so even at a discounted rate there should still be a net savings to solar users. And it isn’t clear why purchasing solar power should be so different from any other source, or how that’s unfair to non solar users.

    • Because the power company is required to buy back any surplus electricity as well as maintain the entire grid so a solar user was getting the benefit of being connected to the grid & getting full retail credit for excess power put back into the grid without having to pay anything for the grid. Therefore non solar users were getting their rates upped to pay for grid maintenence.

    • We have a grid which powers critical infrastructure that we all pay for even if we aren’t the beneficiary. Solar users in Nevada were getting the benefits of that without paying for it. This just made it fair for everyone. That’s all.

    • The grid is not the same as production. With deregulation there are many producers of power but the grid is still maintained by the power company which owns it and maintains it. If you want to produce power you’re free to do so but you shouldn’t then forced the power company to buy it from you at a higher than wholesale rate. You’re a producer like any other producer and you will get wholesale for it now, as well as pay your share of being connected to the grid. You bought equipment to produce green energy, that’s awesome but there’s a reason why power companies don’t do it without huge subsidies and that’s because it costs more to produce than using fossil fuels. This just stops the subsidy coming from your neighbors anymore. Federal tax subsidies are still in place so enjoy that benefit but stop feeling like you’re owed it from your neighbors.

They will attempt to keep people on the grid util they can come up with a new tax to keep the revenue flowing in just as before…. they will not tolerate any loss of this kind of profit.   • The problem is much of he grid costs is rolled into the per KWH charge instead of being a flat monthly service charge. When people start generating their own power, the fixed grid costs don’t change as revenues go down.

    Oklahoma Natural Gas had a similar issue as customers started conserving energy, and variable weather caused unstable revenues. They ended up charging most customers a fixed monthly charge of $33.57 to cover the grid expenses. The gas itself sold AT COST, which is currently 37 cents per therm.

    Expect the same thing to happen with electricity. The KWH prices will remain stable (anybody else notice it’s been about 10 cents for the last 15 years or so?), while monthly grid tie charges continue to increase. Grid tie charges have doubled over the past 15 years.

    Look at your WATER bill. How much of the bill is actually for water? how much is grid tie and other monthly taxes/charges?

Thorium wastes are 10% of a uranium reactor and are only dangerous for 200 years not 10k plus. Also these reactors can break down our existing radioactive wastes. They also are compact and produce massive amounts of electricity that is cheap.

    • This sucked when it happened but part of the problem was the power company was forced to buy back electricity from solar users at full retail price, whereas they can buy electricity from other producers at wholesale price. So they had to maintain the grid at a fixed cost but pay higher prices for their electricity. The state was going to have to subsidize them anyway, which would have cost the taxpayers more. At least that’s their story, but the commission that raised the fees and dropped the resell price was appointed by the Republican governor, so who knows.

      The real issue here is that many of my neighbours bought the solar believing it would pay itself off in 14 years but then the old bait and switch happened and now they’re stuffed.

  • The problem with regulation is there’s always a way to get around, same as Nevada state has gotten around using good sense. The other way is to elect persons with good sense in the first place, and use terrain to advantage. If they are not part of the solution, they are part of the problem.

There is always the complaint of the almighty dollar yet it will still control our lives even when we could have a way to be independent.

  • This sucked when it happened but part of the problem was the power company was forced to buy back electricity from solar users at full retail price, whereas they can buy electricity from other producers at wholesale price. So they had to maintain the grid at a fixed cost but pay higher prices for their electricity. The state was going to have to subsidize them anyway, which would have cost the taxpayers more. At least that’s their story, but the commission that raised the fees and dropped the resell price was appointed by the Republican governor, so who knows.
    The good news is that Las Vegas gets between 15-25% of its power from The Hoover Dam and quite a lot from natural gas (not ideal but better than coal).

    The real issue here is that many of my neighbours bought the solar believing it would pay itself off in 14 years but then the old bait and switch happened and now they’re stuffed.
