70 Years Ago Today, WWII Vets Took Up Arms Against Corrupt Cops and Ran Them Out of Town

Establishment political corruption and election rigging have become so commonplace, the stunning collusion and fraud perpetrated by the Democratic National Committee this year — revealed in several document leaks — seemed virtually inconsequential to vast swaths of the voting public.

To some, however, the coordinated plot to install Hillary Clinton as the Democratic nominee constituted an unforgivable breach of faith, if not outright criminality — particularly since none of those involved will be held accountable. Despite this outrage, a parallel feeling of helplessness also settled in — after all, the disillusioned lamented, what could really be done to thwart such a blatant power-grab?

To those who believe such malfeasance is beyond resolve, perhaps a revisit to the Battle of Athens on its 70th anniversary will offer some perspective.

In 1946, war-weary GIs began to return from World War II battlefronts in Europe and Japan, ready to resume life in their sleepy Tennessee town. What they found, instead, infuriated them to the core. A power-hungry Democrat and his associates had since usurped local government and law enforcement, and had imposed a maniacal chokehold on the McMinn County town through extortive fines, excess laws, and arrests of anyone who opposed them.

While the soldiers were away fighting power-hungry foreign enemies in 1936, Paul Cantrell, a Democrat from a wealthy and prominent family, used that influence to win the position of sheriff. Though many Athens citizens strongly suspected Cantrell hadn’t been elected through entirely legal means, there appeared to be no way to challenge the results.

As the years passed, Cantrell and his deputies took full advantage of Tennessee law which gave the unscrupulous men a fee for each person arrested, jailed, and released. According to some accounts, the lawmen even pulled over buses that happened to pass through town, summarily arrested everyone on board for drunkenness — whether or not they actually were — in order to profit handily from their misfortune. But such arrests and fines required paperwork — which meant traceable money — and to some degree hindered the men’s ability to rake in cash.

“It was less troublesome to collect kickbacks for allowing roadhouses to operate openly,” American Heritage explained. “Cooperative owners would point out influential patrons. They were not bothered, but the rest were subject to shakedowns. Prostitution, liquor, and gambling grew so prevalent that it became common knowledge in Tennessee that Athens was ‘wide open.’”

Because Cantrell and his cronies faced only limited opposition, they thwarted subsequent elections by transporting ballot boxes from every precinct to the McMinn County Jail to be counted behind closed doors. Neutral elections observers became the ‘enemy’ and were frequently forcefully ejected from polling sites, if not arrested.

With nearly 10 percent of the town’s population fighting overseas, the beleaguered citizens didn’t feel there was much they could do to fight the nefarious political machine.

Cantrell eventually moved on to become a state senator, leaving Pat Mansfield to become his successor as sheriff — exactly as they had planned — but by the time soldiers were arriving home, Cantrell intended to resume his position as McMinn County Sheriff.

By 1946, most GIs had returned home to find the liberties and freedoms they assumed they’d fought for quashed by the succession of zealous sheriffs and their deputies, who made a racket of roughing up and arresting the former soldiers. But their profiteering scheme wasn’t exactly well-received.

Rather than accepting this iniquity, the GIs decided to remove the despised kleptocrats from power by running for office on a non-partisan platform. In response, Cantrell publicly accused the former soldiers of plotting to stuff ballot boxes in their favor — to which the GIs offered a $1,000 reward for verifiable proof that no one ever collected. Fully aware of their opponent’s own ballot-stuffing, the military men employed car-mounted loudspeakers to roll through Athens repeating one of their popular campaign slogans: YOUR VOTE WILL BE COUNTED AS CAST.

On election day August 1, 1946, voters thronged to the polls in record numbers. Mansfield had bolstered his staff of deputies by hiring law enforcement from other cities and even other states. Now some 300 strong, the lawmen hawkishly guarded voting precincts — but rather than looking out for fraud, the men roughed up veterans serving as poll watchers and anyone else they considered troublemakers.

Legally-appointed GI representative, Walter Ellis, became the first person arrested by Mansfield’s goons, after he protested ‘irregularities’ observed in the courthouse precinct. Several others soon followed — all arrested without just cause.

But one of the worst incidents occurred when an elderly black farmer, Tom Gillespie, attempted to cast his vote. One of Cantrell’s badged thugs sneered at the old man, “Nigger, you can’t vote here,” and proceeded to punch him with brass knuckles. When Gillespie dropped his ballot and moved for the door, the goon shot him in the back.

Hearing the gunshot, crowds swarmed into the streets, and Mansfield responded by shutting down the precinct and positioning armed guards to prevent access.

Gillespie’s shooting and the sheriff’s actions enraged the veterans, and one of them shouted, “Let’s go get our guns!”

After the former soldiers retrieved pistols, shotguns, and various other weapons, throngs of citizens joined them in surrounding the county jail where at least 25 deputies had run for cover. The GIs began firing in an attempt to draw the errant lawmen out — but it wasn’t until around 4 a.m. that they finally surrendered.

Many called for the corrupt to be hanged, but ultimately they “were taken to the edge of town, tied to trees, stripped naked and told not to come back.”

They eagerly complied.

But even this showdown hadn’t stopped Cantrell — as he retained control of the precincts and had pulled ahead in the election — and thus ordered polling sites to close early.

One fed up veteran, Bill White, who had fought in the Pacific theater, grew more irate as the day wore on and decided to rally his compatriots to action.

“You call yourselves GIs,” he bellowed, “you go over there and fight for three of four years — you come back and you let a bunch of draft dodgers who stayed here where it was safe, and you were making it safe for them, push you around … If you people don’t stop this, and now is the time and place, you people wouldn’t make a pimple on a fighting GI’s ass. Get guns …”

White and several others proceeded to raid the National and State Guard armories and returned, heavily armed, to the jail where Cantrell and the few cronies he had left, remained barricaded inside. They demanded Cantrell exit with the ballot boxes, but were met by silence.

After unleashing an — ultimately ineffective — “barrage of gunfire” on the jail, the men procured “a healthy supply of dynamite,” which worked like a charm: Cantrell and his men promptly surrendered.

Astonishingly, despite all the gunfire, explosives, and brutal force, there were no casualties in the Battle of Athens — even Gillespie survived the gunshot to his back.

Cantrell unsurprisingly lost by a landslide, and the victorious GIs immediately began returning the ex-sheriff’s extorted fees to the grateful citizens — eventually returning order to the long-suffering town.

These events were extreme, and though this momentous victory of citizens over corrupt crony politicians proved something can, indeed, be done to fight establishment malfeasance, armed revolt certainly isn’t a realistic or justifiable option now. But other options, particularly when instituted on a large scale, could prove just as fruitful.

One of the most effective ways to vote doesn’t involve elections or polls at all — withdrawing your money from the corporatist system which funds and backs corrupt politicians can be a decisive method to show your intolerance of their policies. Hit politicians where it hurts them most — their wallets — by growing your own organic food, participating in barter and trade, or by either refusing to vote in national elections or opting instead for a third party candidate.

Be creative in refusing to validate the system that directly permits such corruption — and worse — to continue.

When the law becomes so twisted it allows criminals to operate with impunity, that law is little more than hollow ordinance. If working within the system to change it from the inside isn’t fruitful — think Bernie Sanders — perhaps it’s time to work outside it.

          There is certainly justification at times for defending your rights aggressively. Its a tricky situation though as we see with the current BLM incidents.

          Being calm doesn’t mean being passive, not being angry doesn’t mean accepting injustice. Its just good to approach adversity with a clear mind. There are so many ways to subvert the instruments of injustice without harming anyone. Protests, boycotts, bringing politicians to account through cyber actions like email leaks, filming the police and politicians, and spreading better alternative ideas to people. Real and lasting change is a very grass roots effort, and violent conflict does not create favorable conditions for that sort of organizing. Just rushing the legislature with guns isn’t going to achieve much; and certainly nothing good. See how that worked out for the Black Panther Party, and how it has affected gun rights in the state of California ever since.

      I live in California presently, where tyranny has grown to what could be described as epic levels. You don’t see it all the time in the way that the WWII veterans of McMinn County, Tennessee did, but in some ways it is worse, and the laws that have been passed certainly have been, and are, tyrannical in nature (not to mention unconstitutional). And I’m not just talking about gun laws, either. We contend with laws that (in California) have been proposed or enacted that limit our speech, that have limited our ability to broadcast what the Legislature is doing, and even which have proposed to screen the blood of every person in California for “any disease” (both in an effort to collect DNA samples on every person in the state as well as an effort to remove “undesireables” from the gene pool). As an individual with a disability, I am deeply and profoundly wounded by what California is doing in its rush to circle the toilet bowl hole. Is this State in a condition which we could call not only problematic, but “tyrannical?” Yes, absolutely, it is. What are some ways we can reasonably move forward in light of this?

      In CA / CALifornia, I suggest what I call the C.A.L. method. As follows this is an explainer for how this applies to gun laws, but in principle the C.A.L. method can be applied to any law(s) where the PTB (powers that be) become tyrannical in their enactment of laws, particularly unconstitutional ones.

      C. – Circumvent – This means circumventing laws (basically, by using innovative and technological methods). Used to be you could do
      it by using bullet button. Now examples of what people are using instead are the Franklin Armory DFM 10-round mag, the Monsterman grip, the Armaglock, or the Bullet Button Reloaded, all of which have different Circumvention purposes and techniques.

      A. – Avoid – Different than circumventing laws, avoid the law entirely,
      by making something in your own home (a receiver, say, from an eighty-percenter) and just don’t ever serialize or
      register. (This is basically noncompliance, but it’s actually legal still in California.)

      L. – Leave – Leave the State. Go to Nevada, Idaho, Montana – basically, free holdouts. (Eventually, I’ll be in Idaho, but for now, I’m here.)

      Be prepared, always, to resist. Don’t be afraid of that possibility.

But to divide the USA they had to change history so that there would be division among the American people. But when the US Constitution was written they were already changing slavery here. That was not happening in most of the known world.

        Jesus Christ. You need to read a history book not written by a right-wing loony. There were no, I REPEAT NO IRISH OR WHITE SLAVES. They were indentured servants. THERE IS A DIFFERENCE. Indentured servants had a choice. They could theoretically earn their way free. And most importantly, their children were free. They could not be bought or sold. And the Constitution was written specifically by and for rich, white slave owners. Your narrative overlooks that fact. George Washington. John Adams. Benjamin Franklin. Thomas Jefferson. Alexander Hamilton. James Madison. John Jay. Patrick Henry were all slave owners. Then there is the fact of that pesky 3/5fths of a person clause. The fact is, the only Liberty the Founding fathers were truly concerned with was theirs. Originally, only rich, white, male, landowners were supposed to be allowed to vote.
        I’d be interested to see your sources for this amazing imaginary history of yours. I can supply them for mine.

          FWIW, the 3/5ths thing was specifically to block the Southern states from using their slave population as a basis for obtaining more House of Representatives seats. It was the slave-owning states who actually wanted African slaves to be counted as a full person for the sake of House representation, because that would effectively guarantee the lasting institution of slavery on a federal level.

    We are not working within “the system”. The lawful “system” here in the USA is the US Constitution and it does have remedies for exactly what we are facing. Huh?

    Do you know what the US Constitution is and what it does? It defines our government, it assigns the DELEGATED authority to the (here are the important words to note) different branches and to specific named-in-writing offices within the branches. When you start to understand that those that SERVE WITHIN our governments – state and federal – do not have any authority on their own, but are ALLOWED to use the authority of the branch or office they are occupying – elected, hired, contracted, etc.

    It is the contract that they ALL agree to abide by and take a lawfully binding Oath that they would never go outside that contract. Not taking or breaking the constitutionally REQUIRED Oath is a felony and the crime of Perjury. This is backed up by statutes.

    The requirement for all Federal and State officers to give their solemn and binding Oath is established in Article VI, Section 1, Clause 4.

    Contract is an agreement between two or more parties creating obligations that are enforceable or otherwise recognizable at law. Contracts have a very long history even before the USA was created.

    Federal law regulating oath of office by government officials – state and federal – is divided into four parts along with an executive order that further defines the law for purposes of enforcement.

    5 U.S.C. 3331, provides the text of the actual oath of office the three branches of our government, the military, all law enforcement, the heads of the States, all federal employees are required to take before assuming office.

    5 U.S.C. 3333 requires the three branches of our government, the military, all law
    enforcement, the heads of the States, all federal employees sign an affidavit that they have taken the oath of office required by 5 U.S.C. 3331 and have not or will not violate that oath of office during their tenure of office.

    18 U.S.C. 1918 provides penalties for violation of oath of office described in 5 U.S.C. 7311 which include: (1) removal from office AND; (2) confinement or a fine.

    5 U.S.C. 7311 explicitly makes it a federal criminal offense for anyone employed in the United States Government to “advocate the overthrow of our constitutional form of government”.

    The definition of “advocate” is further specified in Executive Order 10450 for the purposes of enforcement supplements 5 U.S.C. 7311. Executive Order 10450 provision
    specifies it is a violation of 5 U.S.C. 7311 for any person taking the oath of office to advocate “the alteration … of the form of the government of the United States by unconstitutional means.”

    It is important to realize that our form of government is defined by the Constitution of the United States. That according to Executive Order 10450 and 5 U.S. 7311 any act taken by government officials who have taken the oath of office prescribed by 5 U.S.C. 3331 which alters the form of government other then by amendment, is a criminal violation of the 5 U.S.C. 7311.

    Brookfield Construction Company V. Stewart 284 F Sup. 94: “An officer who acts in violation of the constitution ceases to represent the government.”

    The US Constitution and all that is in Pursuance thereof it is the supreme LAW of this nation. It requires that ALL laws/regulations/codes/treaties/etc follow it in order to be lawfully binding upon the American people.

    US Constitution, Article VI, Clause 2: “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”

    So we have the laws and they are all in writing so it cannot be the problem. I believe the problem is enforcement. So WHO is constitutionally supposed to enforce the laws of our land? For the answer to that we go to the US Constitution, Article 1, Section 8, Clause 15.

    Clause 15: “To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel invasions.“

    Also the duties that those that serve within the state and federal governments have TO THE MILITIAS is found in Clause 16. The Militia has as its constitutionally assigned duties to:
    — Enforce the US Constitution (Supreme LAW of this nation) and each state’s Constitution (highest LAW of the state),
    — Enforce and keep the “Laws of the Union” (which are constitutional laws ONLY),
    — Protect the country against all enemies both domestic and foreign, and
    — “to suppress Insurrections and repel Invasions”.

    Clause 16: “To provide for organizing, arming and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress”.

    It is also important to understand that US Presidents are only the Commander in Chief when the Militia and/or the military is called into service. The military is called into service when the Congress declares war. Because that autority is delegated to those that serve within the Congress, it is forbidden to any other within the branch, forbidden to other branches/offices.

    US Constitution, Article I, Section 8, Clause 11: “To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water”.

    George Washington, ex General and ex US President: “It may be laid down, as a primary position, and the basis of our system, that every citizen who enjoys the protection of a free government…, but even of his personal services to the defence of it, and consequently that the Citizens of America (with a few legal and official exceptions) from 18 to 50 Years of Age should be borne on the Militia Rolls, provided with uniform Arms, and so far accustomed to the use of them, that the Total strength of the Country might be called forth at Short Notice on any very interesting Emergency.” (“Sentiments on a Peace Establishment”, letter to Alexander Hamilton; “The Writings of George Washington”)

    Thomas Jefferson: “For a people who are free, and who mean to remain so, a well organized and armed militia is their best security.”

    Samuel Adams: “It is always dangerous to the liberties of the people to have an army
    stationed among them, over which they have no control … The Militia is composed of free Citizens. There is therefore no danger of their making use of their Power to the destruction of their own Rights, or suffering others to invade them..”

    Patrick Henry: “If you have given up your militia, and Congress shall refuse to arm them, you have lost every thing. Your existence will be precarious, because you depend on others, whose interests are not affected by your infelicity.”

    So when those that serve within our governments use any except the Militia for those items listed above it then their actions then becomes *Terrorism against the American people.

    *28 C.F.R. Section 0.85 Terrorism is defined as “the unlawful use of force and violence against persons or property to intimidate or coerce a government, the civilian population, or any segment thereof, in furtherance of political or social objectives”.

    So now you know that ONLY the people as the Militia is to be used to enforce the laws of our nation. What excuse do those who serve within our governments have for creating those armed agencies instead of using the Militia as required?

    Well, the only Militia that can be used for those purposes must be trained as the congress requires the military to be trained, and be educated in both the US Constitution and their own state’s Constitution as it is to those documents they are sworn, and most importantly, they cannot already be serving within our governments. Veterans and some law enforcement have the military training, but they need to be educated in the US Constitution and in their state’s Constitution to meet the requirements and be available if needed by our governments.

    Thomas Jefferson, 1st inaugural, explained that: “a well-disciplined militia” is “our best reliance in peace and for the first moments of war, till regulars may relieve them” and also a guarantee of “the supremacy of the civil over the military authority; [and] economy in the public expense.”

    The Militia is not bound to either the federal or state governments, but are bound to the US Constitution and their own state’s Constitution. That is why they can enforce the laws – they know the supreme law of the nation, and the highest law of their own state. that is also why they are REQUIRED to be used by those that serve within our governments for those purposes listed above. That way they could NOT be ordered to commit a non constitutional act against the American people.

    Understand that we also have the Grand Jury Investigations, Grand Jury, and juries; plus we have elections that are REQUIRED to be honest and free. We are also NOT supposed to allow factions (parties) as they corrupt the system and pit the people against each other. I would lsit all that information but this is long enough as it is.

        But we the people were ignorant and naive. Most still do not understand the Oath is to the US Constitution, not to the person/people serving as a president, or within the legislature, or judicial branches.

        All of our wars since WW1 have really been unlawful ones, probably even WW1.

        If those who wish to keep our nation free would do three things, it would make a huge difference in what is going on.

        Read the US Constitution – understanding that if reading the online one may have been modified unlawfully. This is the contract that ALL – state and general (federal) – are bound to first in importance.

        Read their state Constitution. Those two things are the contracts that all who serve within the state are bound to.

        Start training as the Congress requires the military to be trained if not already – find a veteran; educate yourself better about the US Constitution your state Constitution as the ONLY laws you are then bound to, and must support, enforce, and defend.

        Then, and only then, can you, and others trained like you in the above list can you arrest, charge, etc with the full weight of our legitimate government behind you. It takes a bit more, but that is all the training you will need to be the required Constitutional Militia.

        You, along with other Militia must then make both your state government and the federal government know that you are available to be used for the duties they are constitutionally required to use a constitutionally required real Militia for instead of the agencies that they are at this time using. The Militia is constitutionally REQUIRED to never go against the US Constitution and state Constitutions, and to hold accountable in a lawful manner those who are not doing their duty as required.

        This is taking great preparation on the part of all able-bodied Americans. Hopefully a constitutionally educated military will do their LAWFULLY and constitutionally required duty and join the Militia after leaving the military. The USA, Americans need them to do their lawful duty and keep the REQUIRED Oath to the US Constitution.

    Very interesting that so many people believe that just because Sanders didn’t win the party nomination doesn’t mean his work hasn’t been fruitful. It is because of Sanders that there has been a surge of young voters coming into the Democratic Party. It is because of Sanders that Clinton and the DNC adopted one of the most progressive party platforms in American political history – a move that only came a few weeks before the convention. It is because of Sanders that Debbie Wasserman Schultz is no longer party chairman. It is because of Sanders that 15 progressive Democrats are now receiving more attention and funding for their down-ticket campaigns, and are poised to win office.

    Yes, he got screwed out of the nomination. He knew he was getting screwed out of the nomination from it’s earliest of days. he also knew who was going to screw him, and had a plan for something much bigger than one Presidential race.

    In 2020 you are going to see a vastly different Democratic Party. One that is, dare I say, more democratic, and open, and fair than it’s been in a very long time.

    Of course, that doesn’t mean you continue to support our existing two-party system. It’s crap. Sanders knows its crap. Sanders is taking advantage of a huge weakness in the Democratic Party to push what is, essentially, a third party socialist platform. We still need stronger third and fourth parties. Vote Green. Vote Libertarian. Vote Freedom Party. Vote Constitutional Party. But you have to remember to do more than just say you support a third party. You have to become a part of it. You have to go to meetings. You have to push agendas. You have to get out into your neighborhoods and cities and meet others. You can’t make change sitting at home, you can’t even make significant change clacking away on a keyboard.

    Vote. Fight. Win.

    Bernie Sanders accomplished exactly what was needed and exactly what he set out to do. His campaign was not about him becoming President — it was about raising awareness of the profound problems in this country because of the purchasing of our legislators through legal bribery, and the profound problems we face because we live at the pleasure of the 0.1% who pay the billionaire piper. Bernie’s shown us we can move the needle, and his ideas are an important part of the Democratic Party platform. These include modernizing the infrastructure of our country, making training and education affordable, making medical care accessible to everyone, and keeping our planet livable. Why anyone would identify with a self-proclaimed billionaire who won’t release his tax returns and who chums around with the Russian mob and the KKK is beyond my comprehension.

    Regardless of what people think of Bundy, this country was founded on the presumption of God give n rights to property where no one can usurp it from you. Now they made a bunch of bs tax laws where they can take it from you. Fines sure but taking your land (or even your right to drive) cuz you broke a rule is crazy! I believe in defending your property and if none were armed at the Bundy ranch they may very well have followed through with their threat and opened fire.
    That in my opinion is the single best thing about this country, its constitution. Giving its citizens the legal right, (even if our current or any other including nazi regime, if here, take action against such) the legality to not be trampled on and defend ourselves and rights.
