Oklahoma City, OK – Body camera footage of an arrest in Oklahoma is raising questions after a police officer is seen conducting an illegal search and justifying the arrest by accusing a woman of using her driver’s license as “a weapon.”

The video began when Oklahoma City Police Officer James Herlihy pulled his patrol car over to the side of the street in a residential neighborhood. He got out, and approached a woman on a bicycle, demanding to know where she lived, and then insisting to see her I.D.

Kelsey Pierce said she was riding her bike to work when she was confronted by Herlihy, and when she was told to produce identification, she asked, “What for?”

“Let me see the I.D., or you’re going to go in handcuffs and go in the back of the car until I can figure out what’s going on,” Herlihy said. “Someone called about a female with a black shirt and a backpack.”

Pierce began pulling items out of her backpack to get to her I.D. This included a Halloween costume, which she told the officer she was bringing with her to wear at work. She then pulled out her wallet and opened it. “There’s my I.D.” she said.

Herlihy demanded Pierce take her driver’s license out of her wallet, and as the video shows, she handed it to him. Despite the fact that Pierce was clearly following Herlihy’s orders, he told her to put her hands behind her back, and he proceeded to lock her wrists in handcuffs.

“Gotta make things difficult, I see,” the officer remarked to the woman as she clearly complied with all of his orders and made no attempt to resist arrest.

However, while the video evidence documents one thing, the OKCPD call log published by the Oklahoma City Free Press reveals that Herlihy claimed Pierce “was very hostile and kept throwing items around,” and that she attempted to throwher driver’s license at him.

Although Pierce does not appear to purposefully throw items out of her backpack or attempting to throw her I.D. at the office, she does appear agitated, which could be explained by the fact that she was given very little information about why she was being stopped by a police officer and questioned when she was just trying to get to work.

After pushing Pierce towards the patrol car, and telling her to wait in the backseat, Herlihy proceeded to search through the items in her backpack, before scanning her driver’s license.

Pierce told KFOR News that she was terrified by the ordeal, and she had no idea why it was happening. The officer searched my backpack and searched my bags on my bicycle and then told me that I matched the description of a complaint about a suspicious person,” she said.

Herlihy’s search through Pierce’s belongings, which is documented by the Body Cam footage, occurred without a search warrant and without her permission. Her attorney, Bryce Harp, told KFOR that the officer’s actions were illegal.

“He never told Kelsey why she was being detained until she was in the back of his police car while he was searching her belongings,” Harp said.

While Pierce was forced to sit handcuffed in the backseat of the police car, she tried to explain to Herlihy that she was initially slow when responding to him because he startled her.

“Obviously you weren’t, that’s why you are in handcuffs in the back seat of the car, because you were throwing stuff at me,” Herlihy replied. “You handed the ID card to me like you wanted to use it as a weapon and throw it at me.”

After Herlihy searched for warrants matching Pierce’s name, he let her out of the car, unlocked her handcuffs and told her that she was free to go, while interjecting smug comments about how she could have avoided the arrest by cooperating—even though that is exactly what she appeared to be doing.

Pierce has filed a complaint with the police department regarding Officer Herlihy’s aggressive behavior. While it remains to be seen whether he will be held accountable for his actions, the fact that a police force continues to employ an officer who sees a plastic driver’s license as a weapon when he thinks it might be thrown at him—even when the suspect is an innocent citizen who wants nothing more than to make it to work on time without being detained for imaginary offenses.

  1. I hope the lawyer can prove it was all made up and there was no report of a woman riding a bike with a black shirt on! Even if there was…is that a crime?

    • I believe there was a call like that because it sounds like the type of call cops have to answer. The person that called probably came to the conclusion that she was “Casing his/her house or looking to break into vehicles.” But i also stated that there is nothing criminal about what she, or the lady in the black shirt did. She also starts to answer him one time about what she was doing, but she is either cut off, or stops her explanation.

      Also, to see if there was even a call, and I believe there was, it is real easy to pdove. Just look at the cad(computer aided dispatch) which logs all calls and will have notes, in this case “white female, black shirt, with backpack. Looking in houses.”

    • no BAR ATTORNEY (devil’s advocate) ever would challenge the JURISDICTION of the court or the STANDING of the OFFICER (psychopath) because… the ATTORNEY is an OFFICER OF THE COURT and his 1st duty is to the COURT not the victim…

    • He said that there was a report of a woman looking into driveways. Looking into driveways is not a crime, even if true.

Apparently she didn’t grovel at his feet fast enough when she assertively stood up and ask him why he was asking her to identify herself. So, she filed a complaint for his violation of her rights. and it appears that when a citizen who calls in a “Suspicious” person riding a bike and has not actually seen a crime committed, the police will lick their butt and violate people’s rights to satisfy the callers suspicions? Of course, after reviewing the incident they’ll probably conclude he was well within their policy,regulations, and hey, we know that policy circumvents law and citizens rights……along with police union agreements with local government to give them those extra rights that the badge they wear gets when they break the laws against our citizenry.

    • You articulated the lady’s crime perfectly; she dared to be assertive!
      Assertiveness is acceptable for people having a discussion, but it is not acceptable for a person to speak assertively to a law enforcement officer in this country.
      Soon, words themselves will be considered deadly weapons requiring a violent response by our brave police. And in some cases, they already are.

  9. If I was the lawyer I’d want a copy of the supposed call about a woman in a black shirt. Sounds to me like the cop just wanted to play Power Ranger that afternoon.
    All in all, no matter what the result, he’ll probably get little more than two weeks desk duty.
    I’m sure the local new will be touting him as an ‘award winning officer’. They all are, ain’t they?

  11. I watched that video multiple times, and nowhere could I see where she did anything that he claimed she had done. At no point did she wield her id like a weapon, nor did she throw her belongings at him, or even throw the items, period. She kind of stuffs them back in her bag in a flustered manner, but that is to be expected considering she is being treated like a criminal.

    I am a very big proponent of speaking to people with respect and to explain to them in a very calm fashion, exactly why they are being stopped. I heard nothing in his repeated explanation that even sounded like criminal behavior. At least he let her go instead of trying to push some weak ass charge in her.

    Notice in the report, even though on the video he says his shirt is blue, but that is close enough to black, he lies and says she was wearing a black t-shirt.

  16. This is exactly why cops get a bad rep. I understand the being a police officer is a dangerous and stressful job but this guy is an asshole with an authority complex. Afterall, he did not receive a call about a violent crime only a person “looking at people’s driveways (when did that become a crime anyway?). Did he actually forget that he was wearing a body cam when he started lying about the interaction with Pierce?? On the bright side, this story is not about another unnecessary police shooting and she was released to go on her way….she is white though……..

  17. This is one of the reasons I don’t carry ID unless I absolutely have to.

    This got tested recently when I got pulled over while JOGGING as a shaggy middle aged man through an affluent neighborhood to get to a hillly one for my ‘hill training night’ in prep for a marathon. Was friendly, conversationally responsive, but informationally UNresponsive. Moment of truth came when I politely played the “Terry stop” card (Terry v. Ohio, you can look it up). That’s when the cops either give up and let you go, or start beating you and charge you with felonies if you survive. As God’s Grace would have it, I was allowed to go on my way, with a bit of a tail, er, ‘escort’, but I had a pretty good run nonetheless.

    But it helps to not be ID-able. That was my point. And try to be pleasant while being legally unresponsive.

  18. The only thing i got out of this video is that it is illegal to ride a bike while wearing a black shirt and a backpack in Oklahoma. He said he was looking for someone by that description, not that the other person had done anything illegal either.
