Oakland, CA – A former Oakland public school security officer is facing four years in prison after being found guilty on Tuesday of felony assault.

In May of last year, Marchell Mitchell, 24, was seen on a school surveillance video handcuffing 17-year-old Francisco Martinez before unleashing a fury of punches. Martinez, who also has cerebral palsy, was knocked out of his wheelchair and onto the floor.

According to Mitchell, the altercation began as he was attempting to push Martinez to class. Martinez allegedly slapped the hand of Mitchell, who then answered back by throwing the teen out of his wheelchair and stomping on his face.

It was after this original assault that Martinez spit on the officer.

Martinez told the court Mitchell handcuffed him and eventually dumped him out of his wheelchair and punched him four times during the scuffle. Mitchell said the student threatened to kill him, and was actively resisting his efforts to get Martinez to class, so his force was necessary.

Regardless of any threats, or even the spitting, Mitchell’s actions were entirely unjustified. He was dealing with a young man with a disability, in a wheelchair, and who was handcuffed!

“We acknowledge that there was a small physical exchange prior to the security officer essentially flipping out and attacking the student. But nothing that even remotely could have justified what occurred,” Oakland School District spokesperson Troy Flint said.
